LAS VEGAS, Nev. (FOX5) - New court documents allege that Duane Davis, the man accused of killing Tupac Shakur in Las Vegas in 1996, implicated Sean “Diddy” Combs in the murder in an interview with Las Vegas Metropolitan Police.

The documents were filed July 18 by the Clark County District Attorney’s Office in response to Davis’ request for reconsideration of bail. Judge Carli Kierny will reconsider whether the $112,500 he put up in bond money should be allowed, as prosecutors allege the source of the funds agreed to an exclusive interview deal with Davis.


The nearly 180-page documents lay out new evidence obtained by prosecutors that was not shown to the Grand Jury that indicted Davis, including a 2009 interview with LVMPD in which Davis implicated Combs in paying for the shooting.

In a footnote in the documents, prosecutors say:

“[Davis] has asserted publicly that he only told on himself and wasn’t trying to provide evidence against anyone else in his conversations with police. However, this statement belies this claim, as he suggested that Sean Combs paid Eric Von Martin a million dollars for the killings as well as offered to set up a surreptitious phone call with Terrence Brown, the driver, who, at the time, was still alive. "

Prosecutors said Combs headed Bad Boy Records and was in a feud with Death Row Records, headed by Suge Knight. Bad Boy used MOB Piru’s rival gang, South Side Crips, to protect Bad Boy artists while on the west coast, prosecutors allege.

The documents also include a transcript of Davis’ interview with detectives in 2009. Davis told investigators that Combs said “I would give anything for that dude [sic] head,” in a large room of people, in reference to Knight, who was in the vehicle with Shakur at the time of the shooting.


Davis said years later, Eric Von Martin, also known as “Zip,” had suddenly come into wealth. Davis said this was years after he and Zip had discussed some sort of payment by Combs, who went by “Puffy” at the time.

Davis’ next court hearing is set for Aug. 20. A trial was tentatively set for November.

(Yep) R.I.P., rest in peace, Biggie And Pac, both of y’all should be living But I ain’t tryna beef with him ‘Cause he might put a hit on me like Keefe D did And that’s the only way you’re gonna be killing me” Third in line is “Bad One,” which references Combs allegedly having an explosive planted in rapper Kid Cudi’s car while he was dating Cassie.
